1. Acceptance of Terms

By accessing or using the Recalibrate app, you agree to be bound by these Terms of Service ("TOS"). If you do not agree to these terms, please do not use the app. Recalibrate LTD reserves the right to modify these TOS at any time. You will be notified of significant changes via the app, and your continued use of the app will constitute acceptance of the updated TOS.

2. Description of Services

Recalibrate provides personalized fitness and health plans based on your body statistics and lifestyle data. The app is available on a subscription basis, and certain features are accessible only to paying members.

3. Eligibility

The Recalibrate app is intended for users aged 18 and over. By using the app, you confirm that you meet this age requirement.

4. User Accounts

To use Recalibrate, you must create an account by providing accurate and complete information, including your name, email, age, gender, height, weight, fitness experience, training preferences, sleep, and water intake. You are responsible for maintaining the confidentiality of your account login information and for all activities under your account.

5. Subscription and Payment

Recalibrate is a subscription-based service. By subscribing, you agree to pay the applicable subscription fees through our payment processor, IAPHUB. Subscription fees are non-refundable except as required by law. You may cancel your subscription at any time through the app, but access to premium features will continue until the end of the current billing cycle.

6. User Content

Users may create content within the app (e.g., progress photos, comments, posts). Recalibrate does not claim ownership of this content. You retain all rights to your content, but by submitting content through the app, you grant Recalibrate a non-exclusive, royalty-free license to use, distribute, and display the content for the purpose of operating the app. This license can be revoked by deleting your content.

7. Data Collection and Use

Recalibrate collects personal data to personalize your experience and create your fitness and health plan. Your data will not be sold to third parties. For more information on how your data is handled, please see our Privacy Policy.

8. Third-Party Services

Recalibrate integrates with third-party services such as Adalo, Zapier, and ChatGPT to enhance app functionality. These services may have their own terms and privacy policies, and Recalibrate is not responsible for their practices.

9. Termination

Recalibrate reserves the right to terminate or suspend your account at any time if you violate these TOS. You may also terminate your account by canceling your subscription and deleting your account through the app. Upon termination, your right to use the app will cease immediately.

10. Dispute Resolution

In the event of a dispute arising out of or relating to these TOS or the app, the parties agree to first attempt to resolve the dispute informally by contacting Recalibrate at contact@recalibrate.uk. If the dispute cannot be resolved informally, it will be resolved through binding arbitration in accordance with the laws of the United Kingdom.

11. Limitation of Liability

To the maximum extent permitted by law, Recalibrate LTD will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your use of the app; (b) your inability to access or use the app; (c) any unauthorized access or use of your data.

12. Governing Law

These TOS are governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.

13. Updates to Terms of Service

Recalibrate may update these TOS from time to time. Significant changes will be communicated to users via the app, and you will be required to accept the updated TOS before continuing to use the app.
